On January 28, 2019, the NJDA filed a lawsuit in the Superior Court of New Jersey against the SmileDirectClub. Among other contentions, the Complaint states that "By holding itself out as being in the business of straightening teeth through use of its aligners, paying dentists to make determinations regarding the propriety of treatment and furnishing aligners to persons who paid SmileDirectClub to proceed with treatment, SmileDirectClub is engaged in the unlawful practice of dentistry in this State." An injunction is being sought to prevent alleged unlawful and dishonest competition.
